{"id":84511,"date":"2024-11-21T18:52:18","date_gmt":"2024-11-21T18:52:18","guid":{"rendered":"https:\/\/neutrale.al\/?p=84511"},"modified":"2024-11-21T18:52:18","modified_gmt":"2024-11-21T18:52:18","slug":"vendimi-absurd-i-kushtetueses-berisha-nuk-pengohet-te-dale-jashte-shtetit-por-smud-te-dale-nga-shtepia","status":"publish","type":"post","link":"https:\/\/neutrale.al\/index.php\/2024\/11\/21\/vendimi-absurd-i-kushtetueses-berisha-nuk-pengohet-te-dale-jashte-shtetit-por-smud-te-dale-nga-shtepia\/","title":{"rendered":"Vendimi absurd i Kushtetueses: Berisha nuk pengohet t\u00eb dal\u00eb jasht\u00eb shtetit, por s&#8217;mud t\u00eb dal\u00eb nga sht\u00ebpia"},"content":{"rendered":"<p>Gjykata Kushtetuese merr vendimin p\u00ebr k\u00ebrkes\u00ebn e Sali Berish\u00ebs p\u00ebr shfuqizimin e mas\u00ebs s\u00eb dh\u00ebn\u00eb nga SPAK.\u00a0<br \/>\nGjykata ka vendosur q\u00eb t\u00eb pranoj\u00eb pjes\u00ebrisht k\u00ebrkes\u00ebn e tij, duke shfuqizuar mas\u00ebn e SPAK p\u00ebr ndalim t\u00eb daljes jasht\u00eb vendit, nd\u00ebrsa la n\u00eb fuqi mas\u00ebn e detyrimit me paraqitje.<\/p>\n<p>Njoftimi i plot\u00eb<\/p>\n<p>Gjykata shqyrtoi n\u00eb fillim kriteret e legjitimimit dhe arriti n\u00eb p\u00ebrfundimin se k\u00ebrkuesi i plot\u00ebsonte ato me p\u00ebrjashtim t\u00eb pretendimit p\u00ebr cenimin e gjykat\u00ebs se paanshme bazuar n\u00eb argumentin se gjyqtarja e shkall\u00ebs s\u00eb par\u00eb ishte shkarkuar m\u00eb par\u00eb prej k\u00ebrkuesit n\u00eb funksionin e tij si President i Republik\u00ebs dhe nj\u00ebherazi edhe kryetar i KLD-s\u00eb n\u00eb at\u00eb koh\u00eb. N\u00eb lidhje me k\u00ebt\u00eb pretendim, gjykata vler\u00ebsoi se k\u00ebrkuesi nuk kishte shteruar mjetet juridike n\u00eb dipozicion, konkretisht nuk i kishte paraqitur ato formalisht gjat\u00eb gjykimit t\u00eb zakonsh\u00ebm sipas rregullave proceduriale p\u00ebr k\u00ebt\u00eb q\u00ebllim. K\u00ebrkesa p\u00ebr p\u00ebrjashtim p\u00ebr k\u00ebt\u00eb gjyqtare ishte k\u00ebrkuar p\u00ebr nj\u00eb shkak t\u00eb ndrysh\u00ebm nga ai i m\u00ebsip\u00ebrm.<br \/>\nSa i takon themelit t\u00eb \u00e7\u00ebshtjes, duke mbajtur n\u00eb konsiderat\u00eb shpjegimet e k\u00ebrkuesit dhe prap\u00ebsimet e pal\u00ebve, Gjykata me shumic\u00eb votash, vler\u00ebsoi ta shqyrtonte \u00e7\u00ebshtjen n\u00eb drejtim t\u00eb t\u00eb drejtave kushtetuese p\u00ebr t\u2019u zgjedhur sipas nenit 45 t\u00eb Kushtetut\u00ebs dhe liris\u00eb s\u00eb l\u00ebvizjes sipas nenit 38 t\u00eb Kushtetut\u00ebs.<br \/>\nN\u00eb p\u00ebrgjigje t\u00eb pretendimit t\u00eb k\u00ebrkuesit se, bazuar n\u00eb nenin 73\/2 t\u00eb Kushtetut\u00ebs, prokuroria duhej t\u00eb kishte marr\u00eb autorizim nga Kuvendi p\u00ebrpara se t\u00eb k\u00ebrkonte nga gjykatat caktimin e masave t\u00eb sigurimit personal \u201cdetyrim p\u00ebr t\u2019u paraqitur n\u00eb policin\u00eb gjyq\u00ebsore\u201d dhe \u201cndalim i daljes jasht\u00eb shtetit\u201d, Gjykata b\u00ebri nj\u00eb analiz\u00eb q\u00ebllimore dhe semantike t\u00eb dispozit\u00ebs kushtetuese n\u00eb fjal\u00eb. N\u00eb kuad\u00ebr t\u00eb k\u00ebsaj analize, Gjykata iu referua edhe materialeve t\u00eb procesit legjislativ t\u00eb cilat i paraprin\u00eb amendamentit kushtetues t\u00eb vitit 2012 kur u miratua neni 73\/2 me k\u00ebt\u00eb p\u00ebrmbajtje q\u00eb ka sot, si edhe precedentit n\u00eb rastin Tahiri dhe jurisprudenc\u00ebs s\u00eb Gjykat\u00ebs s\u00eb Strasburgut.<br \/>\nGjykata interpretoi shprehjen \u201cheqje e liris\u00eb n\u00eb \u00e7far\u00ebdolloj forme\u201d bazuar edhe n\u00eb frym\u00ebn e amendamentit kushtetues t\u00eb vitit 2012, i cili synonte reduktim sa m\u00eb t\u00eb madh t\u00eb imunitetit procedural t\u00eb deputet\u00ebve, neni 73\/2 duhet t\u00eb interpretohet ngusht\u00ebsisht si nj\u00eb avantazh i p\u00ebrkohsh\u00ebm procedural q\u00eb e g\u00ebzojn\u00eb deputet\u00ebt n\u00eb funksion t\u00eb mir\u00ebfunksionimit t\u00eb Kuvendit n\u00eb t\u00ebr\u00ebsin\u00eb e tij dhe jo si privilegj i deputet\u00ebve si individ\u00eb. Me k\u00ebt\u00eb frym\u00eb, Gjykata, me shumic\u00eb votash, arriti n\u00eb p\u00ebrfundimin se mbrojtja e p\u00ebrkohshme procedurale q\u00eb neni 73\/2 iu garanton deputet\u00ebve i referohet vet\u00ebm liris\u00eb personale dhe jo liris\u00eb s\u00eb l\u00ebvizjes.<br \/>\nGjykata e shqyrtoi mas\u00ebn e siguris\u00eb \u201cdetyrim p\u00ebr t\u2019u paraqitur n\u00eb policin\u00eb gjyq\u00ebsore\u201d, n\u00eb k\u00ebndv\u00ebshtrim t\u00eb t\u00eb drejt\u00ebs p\u00ebr t\u2019u zgjedhur sipas nenit 45 t\u00eb Kushtetut\u00ebs. Duke iu referuar llojit t\u00eb detyrimit q\u00eb vendos masa dhe shpesht\u00ebsis\u00eb s\u00eb zbatimit t\u00eb tij (nj\u00eb her\u00eb n\u00eb dy jav\u00eb), gjykata nj\u00ebz\u00ebri arriti n\u00eb p\u00ebrfundimin se ajo nuk prek funksionet legjislative t\u00eb Kuvendit dhe nuk e pengon deputetin t\u00eb ushtroj\u00eb t\u00eb drejtat e tij si deputet. P\u00ebr rrjedhoj\u00eb gjykata nj\u00ebz\u00ebri arriti n\u00eb p\u00ebrfundimin se n\u00eb rastin konkret, kjo mas\u00eb nuk p\u00ebrb\u00ebn kufizim t\u00eb liris\u00eb personale dhe, p\u00ebr pasoj\u00eb nuk nevojitet autorizimi nga Kuvendi p\u00ebr zbatimin e saj ndaj deputetit.<br \/>\nGjykata e shqyrtoi masen e sigurimit \u201cndalim i daljes jasht\u00eb vendit\u201d n\u00eb kuad\u00ebr t\u00eb liris\u00eb s\u00eb levizjes t\u00eb garantuar nga neni 38 t\u00eb Kushtetut\u00ebs, e cila \u00ebsht\u00eb e ndryshme nga liria personale e garantuar nga neni 27 i Kushtetut\u00ebs dhe p\u00ebr pasoj\u00eb k\u00ebrkuesi n\u00eb cil\u00ebsin\u00eb e deputetit nuk g\u00ebzon mbrojtje t\u00eb ve\u00e7ant\u00eb n\u00eb k\u00ebt\u00eb aspekt, ndaj Gjykata me shumic\u00eb votash vler\u00ebsoi se k\u00ebrkimi i autorizimit t\u00eb Kuvendit nga Prokuroria p\u00ebr k\u00ebt\u00eb mas\u00eb nuk ishte i nevojsh\u00ebm.<br \/>\nGjykata shqyrtoi pretendimin e k\u00ebrkuesit n\u00eb lidhje me paan\u00ebsin\u00eb e gjykatave t\u00eb posa\u00e7me p\u00ebr shkak t\u00eb parashikimeve t\u00eb ligjit 95\/2016 p\u00ebrkat\u00ebsisht nenet 48-51, t\u00eb cilat parashikojn\u00eb kontrollin periodik t\u00eb llogarive t\u00eb tyre bankare dhe t\u00eb telekomunikimeve vetjake t\u00eb gjyqtar\u00ebve, familjar\u00ebve t\u00eb tyre nga hetuesit e BKH, e cila sipas k\u00ebrkuesit varet nga Prokuroria e Posa\u00e7me SPAK. Gjykata me shumic\u00eb votash vendosi q\u00eb pretendimi i k\u00ebrkuesit \u00ebsht\u00eb i pabazuar p\u00ebr arsyet e m\u00ebposht\u00ebme:<br \/>\nautorizimi p\u00ebr regjimin e kontrollit periodik \u00ebsht\u00eb i parashikuar n\u00eb Kushtetut\u00eb dhe si i till\u00eb nuk mund t\u00eb b\u00ebhet objekt i kontrollit kushtetues;<br \/>\nLigji p\u00ebrmban garanci t\u00eb mjaftueshme p\u00ebr t\u00eb siguruar pavar\u00ebsin\u00eb e gjyqtar\u00ebve n\u00eb m\u00ebnyr\u00ebn se si realizohet kontrolli pasi rezultatet e kontrollit eventual t\u00eb kryer nga BKH jan\u00eb objekt vler\u00ebsimi nga gjykata ne rastet e procedimit penal dhe nga KLGJ n\u00eb rastet disiplinore;<br \/>\nLigji p\u00ebrmban nj\u00eb t\u00ebr\u00ebsi garancish t\u00eb cilat sigurojn\u00eb pavar\u00ebsin e tyre n\u00eb ushtrim t\u00eb funksionit p\u00ebr shkak t\u00eb statusit t\u00eb posa\u00e7\u00ebm t\u00eb k\u00ebtyre gjyqtar\u00ebve \u00e7ka p\u00ebrfshin em\u00ebrimin, pag\u00ebn, karrieren, trajtimin e posa\u00e7\u00ebm dhe m\u00ebnyr\u00ebn e shkarkimit.<br \/>\nGjykata shqyrtoi edhe pretendimet e k\u00ebrkuesit p\u00ebr procesin e rregullt n\u00eb drejtim t\u00eb mbrojtjes efektive, dhe me shumic\u00eb votash vler\u00ebsoi se ai \u00ebsht\u00eb i pabazuar pasi si\u00e7 kan\u00eb arsyetuar gjykatat e zakonshme k\u00ebrkuesit i \u00ebsht\u00eb dh\u00ebn\u00eb mund\u00ebsia e mbrojtjes n\u00eb p\u00ebrputhje me garancit\u00eb proceduriale t\u00eb parashikuara nga ligji.<br \/>\nM\u00eb tej, Gjykata shqyrtoi secil\u00ebn mas\u00eb sigurimi n\u00eb k\u00ebndv\u00ebshtrim t\u00eb parimit t\u00eb proporcionalitetit t\u00eb lidhur me standardin e arsyetimit.
